Al Bundy drives his car to the Mr. Walletwrench Service Station to get the oil changed. He drives the car into the garage, finishes listening to the news on the radio and fumbles around in the back seat to get a magazine. While he is making a cell phone call to his wife, he opens the door to get out, not realizing the car has been joisted ten feet into the air to facilitate the oil change. He steps into mid-air, falls to the ground, and is injured. He sues the station for negligence in joisting the car with him in it.

If these events take place in a contributory negligence jurisdiction, who will most likely win?

a. Bundy
b. Mr. Walletwrench
c. Bundy, but he will recover less than 100%.
d. Neither. The doctrine of res ipsa loquitur applies.
