Constitutional protection refers to those basic protection guaranteed by the U.S. Constitution. ... The due process clause, equal protection, and the fundamental protection of the first amendment relating to speech, press and religion are examples of certain protections guaranteed by the U.S. Constitution.

Basically it means they shouldn't make something constitutionally your right banned.

The Department of Education has arguably been infringing free speech through the application of Title IX in an attempt to limit expression that could be considered to be sexual harassment. All these efforts to limit speech, while with good cause, are just that — efforts to limit speech.  Many argues these efforts are unacceptable because free speech is a cornerstone right and value.  Others argue the competing values of racial and gender equality and the general importance of making students feel comfortable and protected should trump free speech concerns. It’s a pretty good debate.
