Romeo is one who sees that the banishment given to him was "torture and not mercy" due to the fact that he did not want to be separated from Juliet.

Note also that  since the banishment was the  same or worse than death for him and as such, Friar Lawrence's reaction is was that Romeo is in fact unreasonable and ungrateful due to the fact that instead of death, the Prince only banished him and he should have been grateful instead.
