The Eighth Amendment to the U.S. Constitution prohibits the federal government from imposing cruel and unusual punishment for federal crimes
The eighth amendment for the constitution of the United States of America is part of the bill of rights.  This amendment stated that the government can not give you excessive bails or cruel and unusual punishment this also include torture. The High School student stole 10 dollars from his teacher and got the death sentence, This is an example of cruel and unusual punishment.
