Sofia files a suit against Turista Airlines, Inc. Turista responds that it appears from the pleadings that the parties do not dispute the facts and the only question is how the law applies to those facts. Turista supports this response with witnesses' sworn statements. This is:

Counterclaim: can be defined as a situation whereby a plaintiff brought a case to the court of law against a defendant in a suit, and in the process to prove his case before the court brought his evidence to support his or her case before the court. The defendant upon been serve with the suit also proceeded to gather his own evidence with a view to disprove the one brought into the court by the plaintiff in the suit.

This is done with a view to ensure that the judge hearing the case gave the judgment on the case in his or her favour.
