This is a matter of civil law since Criminal law deals with behavior that is or can be construed as an offense against the public, society, or the state—even if the immediate victim is an individual. The government wouldn't have fund since all the money that it has it is based in tax law.
One step forward that cililization gave many years ago was the institution of laws since let´s say the Hamurabi code.
