As long as a line has a slope, it's clear which half-plane is above the line and which is below.  The above half-plane is the solution to y > mx+b and the lower half-plane is the solution to y<mx+b.  

Here we have a line with a negative slope, so we can rule out  A and C, and we want the half plane above the line, that's D.
